Galbani® Caprese Challenge Contest Rules

  1. 1. CONTEST PERIOD: The Contest begins January 27, 2012 and ends July 17, 2012. (“Contest Period”). The Competition (as defined below) will take place during the Regional and National ACF (American Culinary Federation) conferences. Contestants must be present at the Competition at the time and date specified by Sponsor or any such Contestant will be disqualified and forfeit any opportunity to participate in the Cooking Contest and the chance to win a prize, in Sponsor’s sole discretion.

  2. ELIGIBILITY: This Contest is open to the general public. This Contest is open only to the Contestants invited by Sponsor to participate in the Competition. In order to qualify, a Contestant must be twenty-one years of age or older and a resident of the fifty (50) United States or District of Columbia, and must not have been convicted of a felony or misdemeanor for which such Contestant is currently serving his/her sentence at the time of entry or prize awarding. Entrants may be subject to a background check as described in Section 8 to verify eligibility. Employees of Lactalis Deli (“Sponsor”) and its parent companies, affiliates, subsidiaries, advertising and promotion agencies and the immediate family members (spouse, parents, children and siblings, and each of their spouses, regardless of where they live) and persons living in the household of each of these individuals, whether related or not, are ineligible. Void where prohibited.

  3. CONTESTANTS: Contestants will be invited by Sponsor to participate in the Competition. Contestant will then be required to submit to Sponsor: a) a brief bio including the Contestant’s contact information and culinary training and experience of no more than 100 words, in English, via email at CapreseChallenge.com. BIO WILL NOT BE JUDGED; b) a completed participation and publicity release form/waiver; and c) the Contestant’s original recipe twist on a traditional Caprese (mozzarella, basil, fresh tomatoes and olive oil) using Galbani® fresh Mozzarella cheese (the “Recipe,” all materials together “Contestant Entry”). The Recipe can take any form (appetizer, entree, salad, side or dessert). The Contestant Entries will become the property of Sponsor and will not be returned.

  4. SUBMISSION REQUIREMENTS: By submitting a Contestant Entry, Contestant warrants and represents that: (a) it is Contestant’s own original work, (b) it has not been previously published, (c) it has not won previous awards, (d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) publication of the Recipe via various media, including Web posting, will not infringe on the rights of any third party. Sponsor shall have no obligation to publish winning Recipe. Contestant Entry cannot appear to endorse, mention or otherwise contain the name of any other third party, company or person other than Sponsor. Sponsor reserves the right to waive the Contest submission requirements set forth herein in its reasonable discretion. Sponsor reserves the right, in its reasonable discretion, during or upon completion of the Contest Period, to request that any Contestant resubmit his or her Contestant Entry which fails to comply with the Contest submission requirements prior to any judging period.

  5. CONTESTANT NOTIFICATION: The selected Contestants will be notified by telephone and/or email prior to each regional conference, that they have been invited to participate. Sponsor is not responsible for any change in a Contestant’s phone number, mailing or email address. Potential Contestants are subject to verification, including verification of age and a background check, in Sponsor’s sole discretion. If a Potential Contestant is found not to be eligible or not in compliance with these Official Rules, or if any notification is returned as undeliverable, the Potential Contestant will be disqualified. In the event that a Potential Contestant is disqualified for any reason, Sponsor reserves the right to select another Contestant, even if the disqualified Potential Contestant’s name may have been publicly announced. (A) Dates of Notification: I. Southeast Region – Entries must be received by January 27, 2012 and contestants will be notified by January 31, 2012. II. Western Region – Entries must be received by February 17, 2012 and contestants will be notified by February 21, 2012. III. Central Region – Entries must be received by March 16, 2012 and contestants will be notified by March 20, 2012. IV. Northeast Region – Entries must be received by March 23, 2012 and contestants will be notified by March 27, 2012.

  6. CONDITIONS OF COMPETITION: (A) The Competition: I. Contestants will have a total of 70 minutes to prepare their Recipes as follows: II. Forty (40) minutes to cook/prep prior to competition. III. Five (5) minutes for prep clean up. IV. Twenty (20) minutes for assembly and plate presentation to judges. V. Five (5) minutes for final clean up. (B) The Judging: - Scoring is based on a 100-point system. Each Contestant will be judged separately by a qualified panel of judges selected by Sponsor, based on the following criteria: I. Recipe format and clarity – 10 points II. Mise en Place / Composition – 10 points III. Cooking techniques and interaction – 10 points IV. Creative use of ingredients – 30 points V. Taste, texture and temperature – 40 points. Each Contestant will be challenged to prepare his or her Recipe in front of the crowds during the ACF Regional and National Conventions. By competing in the Competition, Contestants hereby agree that Sponsor shall have the right to film and take photographs at the Competition which may include the name, likeness, photograph, voice, opinions, and biographical information of the Contestants, and may be used for advertising, marketing and promotional purposes in connection with the Competition in any and all media now known or hereinafter invented without territorial or other limitation and without approval or additional consideration to Contestants. (C) Competition Guidelines: I. All Contestants are required to attend a pre- and post-competition briefing, at dates and times determined by the Contest committee. II. Contestants will create a total of 4 portions of their Recipe. Three to be served to the judges and one portion is for display and photography. III. Contestants will have a maximum of 20 minutes to recreate four portions of their Caprese Recipe at a tableside-style cooking station using a provided 10” induction sauté pan and 3.5qt induction sauce pan with lid, and one countertop toaster oven. IV. Contestants must provide their own knives, small wares, additional cookware, preparatory bowls, plates, utensils and/or small appliances. All cookware must be induction burner compatible. No additional heat sources will be allowed. V. Excluding the Galbani® Mozzarella, there is a limit of 15 ingredients. Stocks count as an ingredient. The mozzarella will be provided on-site. All other Recipe ingredients are the responsibility of the Contestant. All ingredients will be proctored and only those ingredients listed on the Contestant’s Recipe will be allowed for use. VI. All materials, including ingredients and cooking tools, must be brought by Contestant in generic packaging, which does not contain the trademarks, logos, or names of any third parties, without the permission of such third parties. VII. Contestants will arrive at the cooking stations with all recipe ingredients, mise en place, to include raw and prepared ingredients, and be ready to cook. No peeling, cutting, chopping, etc will be allowed. VIII. Some advance preparation is allowable. At the event, each Contestant will be allowed up to a total of forty-five (45) minutes prep time prior to the competition. Five (5) minutes will be allotted for clean up. Contestants will need to schedule kitchen time with ACF Events, please contact Lana Manning , lmanning@acfchefs.net to coordinate times. IX. Contestants may bring proteins pre-marinated. X. Contestants are allowed to bring in only the whole and raw materials in an unprepared state in the amount stated in their Recipes; however, the judges may allow variances in amounts for products that require further preparation, in their sole discretion. XI. No finished sauces are allowed; however, basic stocks may be brought in as necessary for the assignment. XII. Contestants will work unassisted.

  7. PRIZES: (A) Regional Competition: I. First Place Prize: The Regional Competition Contestant who earns the highest number of points among all judging criteria as determined by the judges in their sole discretion, will win the First Place Prize. The First Place Prize is a check made out to the Contestant in the amount of $750.00, and a $1000.00 Travel Voucher good for airfare and hotel only, to compete in the National Competition. The Contestant has 30 days to make travel arrangements or they will forfeit their win. And the First Place Prize will be awarded to the Contestant who has the next highest number of points. II. Second Place Prize: The Regional Competition Contestant who earns the second highest number of points among all judging criteria as determined by the judges in their soled discretion, will win the Second Place Prize. The Second Place Prize is a check made out to the Contestant in the amount of $500.00. III. Third Place Prize: The Regional Competition Contestant who earns the third highest number of points among all judging criteria as determined by the judges in their soled discretion, will win the Third Place Prize. The Third Place Prize is a check made out to the Contestant in the amount of $250.00. IV. Fourth Place Prize: The Regional Competition Contestant who earns the fourth highest number of points among all judging criteria as determined by the judges in their soled discretion, will win the Fourth Place Prize. The Fourth Place Prize is a check made out to the Contestant in the amount of $100.00. (B) National Competition: I. Grand Prize: The National Competition Contestant who earns the highest number of points among all judging criteria as determined by the judges in their sole discretion, will win the Grand Prize. The Grand Prize is a Gift Certificate in the amount of $7500.00 from a Kitchen Equipment supplier to be named at a later date. II. Second Place: The National Competition Contestant with the second highest number of points among all judging criteria as determined by the judges in their sole discretion, will win the Second Place Prize. The Second Place Prize is a cheese making class sponsored by “Three Shepherds Farm”, valued at $1000.00 and a $1000.00 Travel Voucher good for airfare and hotel only. All travel arrangements will be made through Stovroff Travel, Buffalo, NY. (C) Prize Information: I. If a tie between two or more Contestants arises, it is the sole discretion of Sponsor to select the winner. II. All Prizes and the winning Recipe will be included in Galbani® virtual and actual recipe books and in promotional and press materials, in Sponsor’s sole creative discretion. III. All taxes on prizes are sole responsibility of the 2012 Winners. 2012 Winners shall be issued an IRS 1099 form for prize.

  8. WINNER NOTIFICATION: 2012 Winner will be determined by the Judges and announced at the end of the Competition. The 2012 Winner will receive and will be required to complete, have notarized and return an Affidavit of Eligibility/Release of Liability and Publicity Release within seven (7) days of date of winner announcement or prize will be forfeited. If Sponsor so elects, a potential prize winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsor in its sole discretion. If the 2012 Winner makes any false statement in any document related to the Contest, Winner may be required to promptly return to Sponsor upon demand the prize based on the ARV published in these Official Rules.

  9. CONTEST TERMS: By participating, Contestants agree to: A) abide by these Official Rules and the decisions of the Judges, Administrator and Sponsor, which shall be final in all respects; and B) release, discharge and hold harmless Sponsor, Administrator and Judges including their respective parent company, subsidiaries, affiliates, advertising and promotion agencies and each of the respective officers, directors, shareholders, agents and employees of the aforementioned entities (collectively the “Releasees”), from any liability, claims, or damages arising out of their participation in the Contest and the acceptance, use, misuse or possession of any prize or any use of any Contestant Entry submitted. Except where prohibited by law, by accepting a prize, 2012 Winner agrees to, where legal, Sponsor's and its designees’ use of his/her name, city and state of residence and/or likeness, as well as the Contestant Entry submitted (and, notwithstanding anything to the contrary in these Official Rules, all rights, title and interest in and to the Contestant Entry which may be edited, modified, altered, changed, used alone, together or with other works, content and/or used in distorted, illusory or composite form as solely determined by Sponsor, for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification and, upon request, will provide consent to such use in writing. By submitting a Contestant Entry, Contestant agrees that Contestant Entry will be deemed a Work Made for Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the 2012 Winner irrevocably assigns and transfers to Sponsor all of 2012 Winner’s rights, title and interest in and to winner’s Recipe including but not limited to all copyright and trademark rights, which 2012 Winner may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Contestants hereby waive in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that 2012 Winner may now or later have to their Contestant Entry. Sponsor reserves the right to alter, change or modify the winning Contestant Entry, in its sole discretion. Upon request of Sponsor, the 2012 Winner shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor to be reasonably necessary to establish the ownership of record of the right, title and interest in and to the subject Recipe and of the copyrights transferred and “Moral Rights of Authors” waived under these Official Rules. Should sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment, and the stated agrees to honor and comply with such request. By submitting a Contestant Entry, you agree that your submission is gratuitous and made without restriction, and will not place Sponsor under any obligation that Sponsor is free to disclose or otherwise disclose the ideas contained in the Entry or Contestant Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.

  10. LIMITATION OF LIABILITY: Releasees are not responsible for printing, typographical, human or other errors, problems or malfunctions relating to or in connection with the Contest, including, without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Contest, the announcement of the prize, the processing, tabulation or posting of times in any Contest-related materials. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the judging or Competition process, the operation of the Contest; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Contest cannot be conducted as planned for any causes beyond the control of Sponsor, which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend this Contest, or any portion thereof, and, at its discretion, award the prize in a manner deemed fair and equitable by Sponsor. As a condition of entering the Contest, Contestants agree that: a.) under no circumstances will Contestant be permitted to obtain an award for, and Contestant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but shall in no event include attorneys’ fees. By entering, Contestants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of New York, without giving effect to any choice of law or conflict of law rules. By entering, Contestants consent to the jurisdiction and venue of the federal, state and local courts located in New York City, New York.
